Tadpole Productions Ltd Statement
In general summary we want you to have a successful film shoot and ask that any equipment hired is looked after and that the user is knowledgeable in its use. When asked we will endeavour to advise as best as possible regarding the most suited piece of equipment for your needs but ultimately that decision and consequences rests upon the hirer. We will hire to you in good faith and ask that good faith is returned in timely payment of invoices and taking care of the equipment for the next user who will rely on it. Thank you.
1. Definitions
"Owner" refers to the company or individual supplying the equipment.
"Hirer" refers to the person or entity renting the equipment.
"Equipment" refers to all camera gear, accessories, and related items hired.
2. Hire Period
The hire period begins on the agreed collection/delivery date and ends on the agreed return date.
Equipment is dispatched / collected from and returned to Tadpole Productions Ltd location or from a pre arranged camera house or destination when possible.
Late returns may incur additional charges at the Owner's discretion if it impacts additional hires.
3. Payment Terms
Full payment must be made prior to collection or delivery unless otherwise agreed and pre arranged to pay at end of the hire period upon receipt of an invoice.
For Regular Companies and Hirers 20th of Month following is acceptable.
4. Use of Equipment
The Hirer agrees to use the Equipment responsibly and only for its intended purpose.
The Equipment must not be subleased, loaned, or transferred to any third party without written consent.
The Hirer must comply with all applicable laws and regulations when using the Equipment.
5. Condition and Inspection
The Hirer acknowledges that the Equipment is received in good working condition unless otherwise stated.
Any faults or damage must be reported immediately upon receipt.
The Hirer is responsible for checking compatibility and suitability before use.
6. Damage, Loss, or Theft
The Hirer is fully responsible for any loss, theft, or damage during the hire period.
Repair or replacement costs will be charged to the Hirer, including any associated loss of rental income.
The Hirer is encouraged to obtain appropriate insurance coverage.
7. Maintenance and Care
The Hirer must take all reasonable steps to protect the Equipment from damage, weather, or misuse.
No modifications or repairs may be carried out without prior approval from the Owner.
8. Cancellation and Refunds
Cancellation requests must be made in writing.
Cancellation fees may apply depending on the timing of the cancellation.
Refunds, if applicable, will be processed within a reasonable timeframe.
9. Liability
The Owner shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Equipment.
The Hirer assumes all risks associated with the use of the Equipment.
10. Indemnity
The Hirer agrees to indemnify and hold the Owner harmless against any claims, damages, or expenses arising from the use or misuse of the Equipment.
11. Return of Equipment
Equipment must be returned in the same condition as received, allowing for reasonable wear and tear.
Cleaning fees may apply if the Equipment is returned in an unclean condition.
12. Delivery and Pickup
Delivery and pickup services may be offered by the Owner at their discretion.
Delivery and pickup times must be scheduled in advance and are subject to availability.
The Hirer must ensure that someone is available at the agreed location to receive or hand over the Equipment.
Risk transfers to the Hirer upon delivery and remains with the Hirer until the Equipment is collected by or returned to the Owner.
The Owner reserves the right to refuse delivery or pickup if conditions are unsafe or unsuitable.
Equipment is dispatched / collected from and returned to Tadpole Productions Ltd location or from a pre arranged Camera Rental House or destination when possible.
13. Usage Restrictions
The Equipment must not be used in hazardous, extreme, or high-risk environments without prior written approval from the Owner.
Unless expressly agreed in writing, the Equipment must not be used for underwater, aerial (including drone-mounted), or marine filming.
The Equipment must not be exposed to excessive moisture, sand, dust, smoke, or corrosive substances.
The Hirer must not use the Equipment in situations that exceed the manufacturer's recommended operating conditions.
Any use of the Equipment for commercial drone operations must comply with all relevant aviation laws and regulations, and prior approval must be obtained.
The Hirer is responsible for ensuring proper handling, mounting, and operation when using the Equipment in moving vehicles or unstable environments.
Any breach of these usage restrictions may result in additional charges, termination of the hire, and full liability for any resulting damage.
14. Insurance
If the Hirer does not have suitable insurance, Tadpole Productions Ltd can offer insurance coverage at 10% of Hire Total, subject to separate terms.
Tadpole Productions Insurance is 'New Zealand Wide' only and carries a $2,000.00 Excess payable by the Hirer. International Insurance can easily be arranged at additional cost.
Tadpole Productions Ltd insurance Does Not Cover Helicopters, Unscheduled flights, Drones or Marine work or anywhere the equipment is placed at obvious risk resulting damage or loss.
If the Owner's insurance is not accepted, the Hirer is responsible for ensuring that the Equipment is adequately insured for the full replacement value during the hire period.
The Owner may require proof of insurance prior to releasing the Equipment.
Any insurance policy must cover loss, theft, accidental damage, and transit risks.
In the event of any damage, loss, or theft, the Hirer must notify both the Owner and the insurance provider immediately.
The Hirer remains liable for any excess, deductible, or uninsured portion of a claim.
Insurance does not limit the Hirer's responsibility for proper care and use of the Equipment under this agreement.
15. Consumables
Consumable items are not included in the hire unless explicitly stated.
Any consumables supplied by the Owner may be charged separately and are non-refundable once used or opened.
The Hirer is responsible for ensuring adequate consumables are available for their intended use of the Equipment.
The Owner is not responsible for any loss of data or failure of consumables used in conjunction with the Equipment.
Any consumables provided with the Equipment must be returned in the same condition (unused) or will be charged accordingly.
BlkBrd Cine MANTIS: The Rubber Elastics used on the MANTIS are considered consumables. That is, they do wear and can damage easily. If any Elastic is damaged it will be charged accordingly. Damaged Elastics are not considered part of the standard hire rate.
The Owner checks and maintains the Mantis Elastics and will be in full working condition with each hire.
16. Termination
The Owner reserves the right to terminate the agreement if the Hirer breaches any terms.
In such cases, no refund will be issued.
17. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the applicable jurisdiction.
18. Acceptance
By hiring the Equipment, the Hirer agrees to be bound by these Terms and Conditions.
